All operations conducted on www.ecogots.com, hereinafter referred to as “Ecogots,” will be subject to the “Terms and Conditions of Purchase” outlined in this document. If any aspect is not covered in this document, it will be regulated according to the current legislation in Spain. The order placed by the customer implies their agreement and acceptance of these “Terms and Conditions of Purchase.” Any stipulation made by the customer regarding these conditions cannot differ from those established by Ecogots.
All information listed on the website www.ecogots.com concerning the items, their characteristics, prices, and purchasing conditions, including the forms and conditions of shipping and payment, may be modified by Ecogots at any time and without prior notice. Some aspects of the “Terms and Conditions of Purchase” may be changed by special agreement between the customer and Ecogots, always with the consent of Ecogots.
Orders
Placing an order with Ecogots implies the customer’s acceptance of these legal conditions. No stipulation made by the customer can differ from those of Ecogots unless expressly accepted in advance and in writing by Ecogots.
Any order placed on the website www.ecogots.com will be considered a firm purchase request by the customer.
An order is not final until it is accepted by Ecogots.
It is understood that the customer, at the time of placing the order, has read, understood, and freely accepted these conditions by checking the corresponding box available for this purpose.
Ecogots reserves the right to accept or deny, at its own discretion, any purchase request, extension, renewal, modification, or change of any of the items displayed on its website.
The customer affirms that the personal, payment, and shipping information provided to Ecogots is real and reliable. If Ecogots finds that any or part of this information is false, the purchase will be automatically canceled, and the customer will not be able to claim any refund for expenses derived from the management.
If the customer provides the data of a third person or entity when making the purchase, the customer will be solely responsible for ensuring that the third person or entity is aware of and expressly accepts this situation. All responsibility for damages that may result from this fact will fall entirely on the customer, exempting Ecogots from any responsibility.
Any indication or query made by the customer in the sections designated for comments in the order or subsequent communications will be considered merely informative and will not condition the purchase made (the requested items, the form of payment, the shipping deadlines, the delivery, and, by extension, any of the present purchase conditions).
Ecogots also reserves the right to withhold an order pending any information needed from the customer. Shipping deadlines will be delayed in relation to the time it takes for the customer to respond.
Prices
The prices of the items published on the website are valid except in case of a typographical error and only for orders placed through the website www.ecogots.com.
The price of the items, as well as any of their characteristics, may be reviewed by Ecogots at any time without the obligation to notify such changes to the customer by means other than the display of these changes on its website. However, once a purchase of an item is made, Ecogots is committed to maintaining the current price for the customer at the time the order was placed.
The prices displayed by Ecogots on its website www.ecogots.com do not include the 21% VAT (Value Added Tax) and will be applicable only to customers currently residing in the specific zones for this tax and when the customer’s situation requires it, always respecting Spanish and European laws regarding it. In addition to sales taxes, customs systems in each country will impose the corresponding tax burdens.
Due to its special fiscal regime, the geographical areas corresponding to the Canary Islands, Ceuta, and Melilla are considered extra-community territories. Therefore, purchases made by residents of such territories will be exempt from VAT (customs office expenses and import taxes are not included in the price of the item or the shipping cost).
Payments
The payment for the products will be made using one of the following payment methods: credit/debit card or pre-delivery transfer.
The customer is responsible for paying invoices even if a third party intervenes on behalf of the customer, so the responsibility for providing authentication, access, or identification data to a third party is solely the customer’s.
If a charge on the credit card is returned and the reason for the return is not a direct error attributable to Ecogots, the amount charged to the customer will have an additional fee of 5% of the returned amount, covering both banking commissions and collection management expenses. This amount will be charged to the customer within the deadlines and forms deemed appropriate by Ecogots.
In any case, Ecogots reserves the right to decline an order or modify the payment method as it deems appropriate.
The customer will receive, by email, along with their order request, the necessary information to make the transfer or deposit for the corresponding payment.
At the time of payment, the customer must indicate in the concept of the bank document the order number, including also, if possible, their name and surname. The deposit or transfer must be made within 2 days following the date of the order request to avoid problems with its validation and location.
Transfers within Spanish territory usually take 1 or 2 days to become effective. In any case, the order will not be considered effective until our management department has the bank confirmation of the payment.
The purchase amount must be received by Ecogots free of banking commissions or other expenses derived from the transaction.
In addition to the above, payment for purchases should be made in EUROS, and all possible banking commissions for currency exchange will be borne by the customer.
When making an international transfer, the customer must always indicate to their bank that they will bear the banking commissions and expenses derived from the transaction. Otherwise, Ecogots may withhold the shipment of their order if the full purchase amount is not received.
Card Payment
For credit card payments, the operation is authorized by the card issuer of the customer through a connection via the payment gateway (CYBERPAC virtual POS) of “La Caixa.” The customer will access a controlled environment where they will provide their card data directly to the bank, which will connect them with their bank to authorize the transaction. In this way, the payment will be made directly, legitimately, and securely, maintaining the confidentiality of the card information at all times. The confidentiality of their data is fully guaranteed, both regarding their personal data and their credit card data for payment processing. Ecogots does not store any card information on its website, as all card information is entered directly into the virtual POS.
Since the specific legislation of each country regarding the customer’s responsibilities for the payment of products purchased by credit card may differ from Spanish regulations, only customers residing in Spanish territory can pay for their purchases using this payment method. Payments are accepted through most types of credit cards (Visa, MasterCard, and JCB).
Credit card fraud is a crime, and Ecogots will take legal action against anyone who performs or attempts to perform a fraudulent transaction or scam.
Bank Transfer Payment
Transfers must be made to Ecogots to our account number. To facilitate tracking, please indicate the order number for which the payment is being made in the transfer concept. It is crucial to remember this, as Ecogots will recognize and locate your payment by your order number. For offers conditioned by date, payment must be received by the marked dates; otherwise, it will not be valid.
Shipping
Shipping costs are included separately at the end of the order and vary depending on the destination.
Delivery will be considered made when the carrier has made the products available to the customer and the customer has signed the delivery receipt document. It is the customer’s responsibility to verify the products upon receipt and to note all reservations and claims that may be justified on the delivery receipt document.
Ecogots does not commit to any urgent shipping. The delivery deadlines offered by Ecogots are approximately 10 working days. However, their delay will not imply the cancellation of the order or any compensation. Any penalty clause for delay introduced by the customer in their order is null and void by the application of the first point of the sales conditions.
Ecogots will always try to ship the products by national transport. However, it reserves the right to send them by any means it deems appropriate if necessary to fulfill its commitments. The shipping price of the order will be reflected at the time of placing the order.
If any unforeseen event occurs regarding the supply of the main material by our supplier, our customer service department will notify the customer, giving them the possibility to cancel the order or change it.
Returns
Ecogots does not allow returns of its products, whether personalized or not.
Limitation of Liability
The information provided on this site by Ecogots is for informational purposes only, and therefore Ecogots accepts no responsibility for its content (such as the suitability of a product for a particular purpose).
Unless expressly stated otherwise, neither Ecogots nor any of its directors or employees will be liable for any damages arising from the use of this site. In particular, they will not be liable for any damages caused to persons and/or property, nor for the total or partial loss of data and information, nor for the expenses and/or loss of profits that may occur from the use of the products we market.
The prices, characteristics, and availability of the products marketed by Ecogots may vary without prior notice.
Jurisdiction
Ecogots hopes that any disagreements that may arise will be resolved amicably. When this is not possible, the customer expressly submits to the jurisdiction of the Courts and Tribunals of Barcelona (Catalonia) for resolution.
